1.1. Harrods.com, an e-commerce website (the “Website”) is operated by Harrods Limited, a retailer with the company number 00030209 and VAT number 629 273 423, whose registered office and flagship store is located at 87–135 Brompton Road, London SW1X 7XL (“Harrods”). 1.2. References to ‘Harrods’ are references to Harrods Limited or another Harrods company within Harrods’ Group.
1.3. Harrods has an agreement with Global-e, a sales facilitation and e-commerce partner of Harrods, allowing Global-e to act as the merchant of record, in Global-e’s name and on behalf of Harrods. Where used in these Terms of Sale, “Global-e” means the applicable Global-e Contracting Party, as defined below.
1.4. Products or services (“Product”) are made available to you for purchase through the checkout.
1.5. By placing your order to purchase one or more Products (each, an “Order”) through the checkout, you confirm that you have read and understood these Terms of Sale, the Security & Privacy Policy and the Cookie Policy (which is available on the checkout) (together, “Terms”) in their entirety, and you agree to be bound by them.
1.6. These Terms define your legal relationship regarding the checkout, the placement of Orders, and the purchase and delivery of Products underlying such Orders.
1.7. If you do not agree to the Terms, please do not complete your Order.
1.8. These Terms are in, and are governed by, the English language. You agree that any translation, if provided, is available for your convenience only (unless otherwise required by applicable law).
1.9. If you are placing your Order for delivery into one of the following countries, please refer to section 19 below, to access additional and specific terms that apply to you: Australia, Brazil, Canada, Japan, any destination or country which is a member of the European Economic Area (EEA) or the United Kingdom and the United States.
1.10. 2.1. Placing Orders through the checkout is reserved exclusively for individuals (or companies) purchasing Products for their own personal use who, in the case of an individual, is no younger than 18 years of age (“Consumers”).
2.2. By placing an Order, you represent and warrant that: (i) the Order and purchase of Products thereunder is strictly and solely for your personal use, and not for resale, distribution or any other commercial activities; and (ii) you are legally capable (in terms of age and capacity) of entering into binding contracts per the local legal requirements in the geographical location where you reside.
2.3. Orders are placed through the checkout by clicking on the “Pay Securely Now” button (or similar button). The checkout displays the Products you purchase, the price thereof, delivery costs and fees (“Delivery Costs"), any applicable import or sales taxes (such as Value Added Tax, Goods and Services Tax, Consumption Tax), and, if available for pre-payment, import duties, tariffs and similar costs and fees that may be imposed by the delivery destination (collectively, "Duties and Taxes"). Please make sure you review your Order carefully so as to identify and correct any input errors prior to placing your Order.
2.4. Where the Website offers you the option to purchase the Products in your local or chosen currency, the price of the Products may change from time to time due to exchange rate fluctuations. The price, Delivery Costs and Duties and Taxes (if available for pre-payment) of the Products you purchase, will be those that were displayed to you on the checkout at the time you actually placed your Order.
2.5. The checkout page will specify the payment methods available for your Order. The availability of such payment methods is dependent on your geographical location.
2.6. You acknowledge and agree that: (i) Global-e will use one of its third party payment processors providers ("Payment Processor") to process your payment (while Global-e is acting as the merchant of record), using the payment method you have selected on checkout and Global-e may use the tools, technology or the services of the Payment Processors to process the transaction on its behalf; and (ii) you will provide valid and current information about yourself for this purpose.
2.7. If the payment method you selected for the Order supports pre-authorization mechanism (e.g. most credit/debit cards), then when you place the Order, the applicable amount will only be authorized, and you will be charged on the earliest of up to 5 days following the date of Order or once the Product has been dispatched to you.
2.8. If the payment method you selected does not support pre-authorization mechanism, the charge will be immediate upon placing the Order (noting however that specific payment methods may support a different timing and Harrods and Global-e may not know or be in control over such timing, if applicable. Please check the provider of your selected payment method’s terms of service for more details). Please note that you will be charged the full Order amount even if the Order will be dispatched in parts or if it is a ‘pre-order’ or similar type of order.
2.9. The Website displays the characteristics of the Products you order. There could be minor differences between the Products you eventually receive and their visual display on the Website or checkout (e.g. in relation to appearance / colour / texture / finish) as all pictures and images of Product displayed are for illustrative purposes only. Where dimensions and measurements are provided in the description of each Product, the dimensions may vary slightly in real life, and it is your responsibility to ensure that the actual size of each Product is suitable for your purpose (including whether there is appropriate and safe access to your delivery address for delivery of the Product). Please read the descriptions and details of the Products carefully before placing the Order. This clause does not limit or exclude consumer guarantees or warranties which cannot be excluded under applicable consumer rights legislation explicitly prevailing the governing law hereof.
3.1. The information contained in these Terms, and the information displayed on the Website and checkout, constitute only an invitation to contract. Your Order is not accepted (and therefore no commitment is made to sell or provide you with the Products), and no contract for the sale of such Products will come into effect, until you receive an email explicitly stating that the Order has been accepted and confirmed ("Order Confirmation"). The contract is concluded in the dispatch country (where the contract for the sale of the Order is concluded).
3.2. The Order is subject to fraud checks and other mandated regulatory checks (including for individual, companies or other entities that are on a restricted list issued by a government or other relevant legal authority, such as ‘Denied Parties Screening’). You may also be required to provide additional verifications and information before, and as a condition to, the acceptance of any Order (mainly if there is suspicion that the identity, address, email address and/or payment information were used fraudulently or in an unauthorized manner).
3.3. In certain circumstances your Order may be declined or cancelled (in full or in part), whether before, or after an Order Confirmation was received. For example, either Harrods or Global-e may, in their sole discretion, decline or cancel (in full or in part), any Orders which did not successfully pass the above mentioned fraud and regulatory checks, any Orders which are suspected to be placed in bad faith, or Orders which were not placed by Consumers. Orders in relation to which the payment information you provided cannot be verified, if a Product included in the Order is unavailable or if your Order is otherwise not made in compliance with these Terms.
3.4. Harrods and Global-e also reserve the right, each in its sole discretion, to decline or cancel an Order (in full or part) in case of actual or suspicious circumstances (related to us, you or any third party) of a good faith, genuine or honest error, mistake or misunderstanding (an “Error”) where without such Error the Order would not have been accepted or dispatched and a contract to sell the Product(s) underlying the Order would not have been agreed to or when such Error was abused by you to purchase such quantity of items which otherwise would not have been purchased or considered to be a regular order. An example could be a improbably low price for an item otherwise costing significantly more, which may or may not be in the context of a ‘sale’ or special promotion. Neither Harrods nor Global-e will be under any obligation to honour an Order in such erroneous circumstances.
3.5. In each event described above where an Order was cancelled or declined, you will be refunded in accordance with these Terms (provided your payment had been processed successfully).
3.6. Quantity limits (per order, per address or otherwise) may apply in relation to certain Products, and excessive Orders could be declined at any time for that reason, without notice.
3.7. Unless otherwise required by applicable law, neither Harrods nor Global-e is required to provide a reason for declining or cancelling any Order, but may do so in their sole discretion.
4.1. Depending on where you are based, you may be able to pre-pay Duties and Taxes on your Order on checkout. Please note, not all products and not all destinations support pre-payment of Duties and Taxes, and we cannot guarantee that your Order will be eligible for such pre-payment. The Website or checkout will provide details, and itemize or indicate if the price paid is inclusive or exclusive of Duties and Taxes before you complete and place the Order.
4.2. If Duties and Taxes were not paid when you placed your Order, either because you so elected or because pre-payment of Duties and Taxes is not available in the delivery destination (or for any other reason): (a) you are advised that the amount of Duties and Taxes displayed under the pre-payment option on the checkout is only an estimation and may not reflect the amount of Duties and Taxes actually charged to you by the broker, carrier or the relevant authority, and that such amount might be higher than the estimation; and (b) you will be fully responsible for paying all applicable Duties and Taxes directly to the relevant authority as determined and assessed by such authorities. Global-e and Harrods will have no responsibility or liability where you are responsible for paying Duties and Taxes and have failed to do so. Moreover, if you fail to pay any Duties and Taxes without a reasonable justification for failing to do so, such Duties and Taxes may be deducted from any refund issued to you by Global-e.
4.3. Global-e may contract with customs brokers or use fiscal representatives to act on its or your behalf for the purposes of clearing the Order into the relevant destination. Global-e may also act as, or use its affiliates as, a ‘customs declarant’ to clear the Order into the destination in Global-e’s name on your behalf. Your agreement to these Terms constitutes a consent and authorization for such customs brokers, fiscal representatives or affiliates to act on your behalf (as an agent, declarant or as otherwise applicable) to: (a) transact with the applicable authorities; (b) complete, submit and execute related documents on your behalf in connection with the import and clearance of Products; (c) facilitate payment of Duties and Taxes and customs clearance; and (d) if applicable, return such Products (subject to these Terms).
4.4. Unless explicitly stated otherwise in section 19 below, you (and not Global-e, Harrods or anyone acting on Global-e or Harrods’ behalf) will be fully responsible for claiming back any Duties and Taxes from the applicable authority (regardless of the process of payment used), where you have returned Products or are otherwise eligible for a rebate of Duties and Taxes. Neither Global-e nor Harrods will have any responsibility or liability in connection with such Duties and Taxes rebate claim.
4.5. If you elected not to pre-pay Duties and Taxes, or failed to pay Duties and Taxes, or refused to accept a Product (where such refusal is not permitted under these Terms), in each case resulting with the Product being returned or needing to be returned, then, in addition to the above, you may be liable for the applicable return costs and charges, and any additional direct or indirect charges resulting from such failure or refusal.
5.1. The title to the Products you order via the Website is transferred from Global-e to you prior to import, provided Global-e is satisfied that full payment for the Order amount has been or can be made.
5.2. Risk of damage or loss is transferred to you upon delivery to the delivery address specified in the Order (in case you have selected not to pre-pay Duties and Taxes, such location will be deemed to be the port of entrance to the import destination).
5.3. YOU WILL BE CONSIDERED AS THE ‘IMPORTER OF RECORD’ OF THE PRODUCT, AND GLOBAL-E (OR SOMEONE ON ITS BEHALF) WILL ONLY BE FACILITATING THE IMPORTATION ON YOUR BEHALF, AS YOUR AGENT, AND MAY, IN CERTAIN CASES, ACT AS THE ‘DECLARANT’ FOR THE SOLE PURPOSE OF FACILITATING THE CUSTOMS CLEARANCE (HOWEVER THIS WILL NOT CHANGE YOUR STATUS AS THE IMPORTER FOR PERSONAL USE PURPOSES).
5.4. YOU ARE RESPONSIBLE FOR ENSURING THAT THE PRODUCT CAN BE LAWFULLY IMPORTED INTO THE DESTINATION, AND YOU THEREFORE NEED TO COMPLY WITH ALL APPLICABLE LAWS, REGULATIONS, CERTIFICATIONS AND RULES OF THE DESTINATION INTO WHICH YOU IMPORT THE PRODUCT.
5.5. Please note that: documentation such as packaging, user manuals, product care labels, handling instructions or safety warnings may not be in your language; you may not have available manufacturer’s or other service options for the Product or parts thereof; the Product (and accompanying materials) may not be designed, or labelled, in accordance with the requirements, standards, product regulations or specifications in the destination to which you import the Product; and any text on the Product may not be in yours or the import destination’s language. If the Product is powered, it may not conform to the destination power parameters such as voltage or other electrical standards (for example you may need to use an adapter to charge your Product). Product ordered to a destination with different standards cannot be returned for this reason and no liability will be assumed by Harrods or Global-e in any circumstances which may arise from your purchasing of Product without the correct standards for your destination.
6.1. The delivery and fulfilment of your Order is carried out by various delivery partners. These are selected and operated by Global-e or by Harrods (a "Delivery Partner").
6.2. Unless otherwise stated, and subject to applicable laws, delivery dates given on checkout (or on the Website) are estimates only. The Order will be delivered by the latest delivery time set out on checkout (based on the delivery method you selected, if such selection was available for your Order) or, if no delivery time is specified, within 30 days following the Order Confirmation date, unless exceptional circumstances exist (pre-order for example).
6.3. Delivery timeframes depend on your delivery address and your chosen delivery method. Neither Global-e nor Harrods are able to specify an exact delivery date and time. Where Harrods is unable to deliver your Order within the periods mentioned above, Harrods reserve the right to cancel your Order.
6.4. Delivery will be completed when the Product is delivered to the address chosen by you as specified when placing your Order (where Duties and Taxes have not been paid in advance, that may include the port of entrance to the country destination). Different parts of your Order may be delivered on different dates as confirmed in your confirmation email or as otherwise communicated to you by Harrods (such dates being estimates only).
6.5. Neither Global-e nor Harrods accept any liability for any loss arising from a delay in delivery.
6.6. If you receive notification of a failed delivery attempt, it is your responsibility to use the details provided by the Delivery Partner for re-delivery. Efforts will be made to deliver your Product according to the details specified in your Order.
6.7. Some Products may not be delivered to certain locations or destinations (due to limitations imposed on the Product itself or by the destination). You will be informed of such limitation, either on the Website or checkout, and the checkout should not permit you to submit your Order if the Product cannot be delivered to your specified address. However these restrictions are subject to change dependent on a number of factors, including local import restrictions. Harrods can only deliver to one shipping address per Order, including hamper orders.
6.8. Harrods and Global-e reserves the right, at any time, to suspend or cancel the delivery of any Product that cannot be legally delivered to you.
6.9. In certain circumstances, the Delivery Partner may offer alternative delivery options, including providing the following options: signature release – opting out of the requirement to provide a signature on delivery (where such option is offered as part of the chosen delivery service); and/or leave with neighbour – redirecting the delivery to a neighbour (“On Demand Delivery Service”). By selecting to receive your Order via one of these options, you acknowledge and agree that neither Harrods, Global-e nor the Delivery Partner is responsible or liable for any loss or damage that may result from this service.
6.10. For some Orders, the Delivery Partner may require proof of ID upon delivery.
7.1. Harrods offers a Collect in Store service to collect your order at certain Harrods locations. If Collect in Store is available for your Order, this option will be displayed at the checkout. Please note that Collect in Store is not available for all purchases or at all Harrods locations.
7.2. Once you have selected Collect in Store as your delivery option and completed your order, Harrods cannot re-direct your order to another location or address.
7.3. Global-e or Harrods will notify you when your Order is ready to collect at your chosen Collect in Store location during the relevant store opening hours. Please note that Collect in Store delivery timeframes are provided as an estimate only.
7.4. You must bring your order confirmation email and valid proof of ID to collect your Order.
7.5. Harrods will keep Collect in Store orders for 10 days at your chosen Harrods location before returning items to Harrods’ distribution centre. You will be issued a refund when the Order has been received at Harrods’ distribution centre.
7.6. Neither Harrods nor Global-e shall be liable for any losses or expenses suffered, or any disappointment caused by your failure to collect your order within the timeframes above or if you fail to provide appropriate documentation to collect your Order.
8.1. Depending on your location, payment may be made to an intra-group affiliate of Global-e [(listed <<<here>>>)], and such payment will constitute a payment to Global-e and will discharge you from your payment obligations in connection with the Order and purchase of the underlying Products.
8.2. Global-e may not be able to control additional charges, fees (such as foreign transaction fees or cross border fees) or surcharges imposed by your own bank, card issuer or your chosen payment method. Global-e may not have any knowledge in advance of the applicability of such fees or surcharges nor does Global-e have any way to mitigate these fees or surcharges, as their applicability will depend on your bank, card issuer or payment method and their own policies. Global-e’s sole commitment in this respect is to acquire the amount specified on checkout in your selected currency.
8.3. Your trust in Global-e to process your Order is important to Harrods and Global-e and together we are committed to safeguarding your payment details by implementing strong security measures. Whilst we strive to maintain the highest levels of protection, please be aware that neither Harrods nor Global-e can be held liable for loss you may suffer as a consequence of accessing or ordering from the Website from an insecure device, or if unauthorised access to the Website is obtained from lost credentials. We recommend you access the Website from trusted devices with up-to-date software, and by using a unique password for our site and avoid reusing passwords from other platforms and services.
8.4. The transaction statement (of your chosen payment method) regarding the Order you placed via the Website will look substantially like this: **Global-e//Harrods**.
8.5. When using PayPal/PayPal Express as a payment method (if available), the full amount of your purchase may be charged immediately following the placement of the Order.
8.6. Gift Cards can be used as a payment method for purchases made in-store and online (for orders placed for delivery in the UK only). Please see section 13 below for further information relating to Gift Cards.
Harrods may, from time to time, offer you the opportunity to participate in competitions and offers. You may be able to participate in such competitions and offers by purchasing certain Products from the Website and fulfilling certain conditions in relation to such purchases, in which case separate terms and conditions in relation to each competition or offer will apply in addition to these Terms, which can be found in Competitions & Offers.
10.1. This returns policy applies to all Consumers, but does not apply to faulty products or to such other excluded products as further detailed in section 8 below (“Limitation On Returns Policy, Withdrawal Rights And Cancellation Rights”).
10.2. In addition to your statutory rights, unwanted Products may be returned for a refund if they are returned unused and in their original condition. Harrods offers a full refund (excluding delivery costs) on any items in relation to which a return was raised (in accordance with section 9.3) within 14 days from the day after the date you received the Order, and returned within 14 days thereafter (unless otherwise required by applicable law).
10.3. Instructions for Return – if you wish to return one or more Products purchased pursuant to these Terms, the following instructions apply:
10.3.1. You must inform Harrods of your decision to return the Product by visiting the returns portal and follow the instructions provided, including providing proof of purchase (your Order identification number and the email address used for the Order), indicating the applicable items to be returned and the quantity thereof and selecting the applicable method of returning the product (if different options are available). If you have any issues accessing the returns portal please contact Harrods Customer Service.For your convenience, Harrods provides a free pick-up service for selected returns.
10.3.2. A return Product authorization ("RMA") number will be provided to you (through the returns portal and via e-mail) and a return shipment label will be generated.
10.3.3. Once you have initiated your return on the returns portal, promptly send back the returned items in accordance with the instructions provided to you in the return portal. You must return the items no later than 14 days from the day on which you initiated the return using one of the delivery methods set out in this section. The RMA number must be included with the return package. Unless otherwise specifically stated, items must be returned in a new and unused state, in perfect condition, with all protective or other materials in place and tags and stickers attached to them (if applicable), as well as with the original box / container, including all accessories and documents. All returns are inspected upon return and will be subject to strict quality control checks. If through your handling the Product(s) have decreased in value, we may refuse the refund or deduct the amount of such loss from the amount to be reimbursed to you.
10.3.4. Upon receipt of the returned item, subject to confirmation that it has been returned in accordance with the returns process, you will be reimbursed for the actual price paid for the returned item (less any deductions). Your refund will be processed as soon as possible, however, please note that, depending on your bank/card issuer, it may take up to 10 working days for your refund to appear in your account (unless your bank has a different time frame as set forth in your bank/card issuer terms).
10.4. For Click and Collect orders, you can also return your unwanted items to any Click and Collect location.
10.5. Refunds on purchases made on an event day or with other promotional discount will be calculated at the reduced price. Where a complimentary gift has been issued with a purchase, the gift must also be returned.
10.6. Purchases made during Harrods’ Christmas period may be subject to different returns policies.
10.7. Please contact Harrods’ Customer Service team to arrange a return for a Product purchased in one of Harrods’ airport stores.
10.8. Harrods cannot process your returns in-person via Harrods’ distribution centre.
10.9. While Harrods offers free returns for all orders, the original delivery cost will not be included in your refund. Please note if you return an item, the taxes and import duties will be refunded to you if they were originally included in the purchase price. If they were not included, you will be responsible for reclaiming duty directly from your local Customs office (see section 4.4 for further information).
10.10. Title and risk to the returned items will not transfer back until such items have physically arrived back with Harrods, and therefore if you choose to return your item by post (not using Harrods’ preferred returns carrier) you are advised to use a courier service offering tracked service, and to have adequate insurance to cover the cost of the goods in transit, as neither Harrods nor Global-e will be liable for such goods. If you are returning your Product by post or courier service, please include your personal details and the best way for Harrods to get in touch with you; otherwise it will not be possible to process your refund.
10.11. Unless expressly agreed otherwise, reimbursement for returned goods will be made using the same means of payment as you used for the initial transaction.
10.12. Harrods monitors the number of returns being made by customers. Continued, or high numbers of returns within a short period, may be deemed by Harrods (in its sole discretion) to be evidence of a breach of these Terms.
10.13. This returns policy may be changed from time to time at Harrods’ or Global-e’s discretion.
10.14. This returns policy is in addition to, and does not affect, the separate legal cancellation right which is available only to EEA Consumers and withdrawal right which is available to UK Consumers, in some circumstances as explained below. For special provisions regarding Consumer Withdrawal Rights (European Economic Area only) or Consumer Cancellation Rights (UK only) – please refer to section 20 below.
11.1. To the fullest extent permitted by law and notwithstanding anything to the contrary in these Terms, certain types of product (unless faulty) are not eligible for cancellation, withdraw or returns, including:
11.1.1. products that are personalised, bespoke, altered or otherwise made to your specification;
11.1.2. perishable goods (including food and beverages, and some hampers);
11.1.3. beauty products, fragrances and pharmaceutical products;
11.1.4. certain accessories (hosiery and pierced earrings);
11.1.5. underwear, nightwear and swimwear, unless the protective adhesive strip is still in place and the item is in a saleable condition;
11.1.6. mattresses, divans (where they come as part of a set with a mattress), duvets, mattress toppers/protectors or pillows;
11.1.7. pharmaceutical products; and
11.1.8. any other products designated as non-refundable at the time of purchase.
11.2. In addition to the list above, the following items cannot be returned for purchases made in-store at Harrods, Knightsbridge or at one of Harrods’ airport stores:
11.2.1. fur items and exotic skins;
11.2.2. limited-edition items;
11.2.3. eveningwear;
11.2.4. millinery, scarves, and hair accessories; and
11.2.5. certain homewares (beds, bedding and purchases from Halcyon Gallery).
11.3. Refunds and exchanges will not be permitted for purchases made in-store on sale purchases after the last day of the applicable sale.
11.4. Only the buyer will be entitled to any rights of return, cancellation or withdrawal (as applicable) and a refund of applicable monies. In no event will a person who has received the Order as a gift be entitled to receive a refund.
11.5. This section 10 does not limit or exclude consumer guarantees or warranties which cannot be excluded under applicable consumer rights legislation explicitly prevailing the governing law hereof.
12.1. All hampers, including those from Harrods’ Christmas range, are itemised and described in detail on the Website. All items shown are subject to availability. Please carefully check the contents of each hampers and product ingredients before placing an order. All wines are 75cl and spirits are 70cl unless stated otherwise.
12.2. If, due to unforeseen circumstances, an item in a hamper or gift box needs to be replaced, the substitution will be of equal or greater value.
12.3. Props such as ribbons, glassware, cutlery and decorative accessories used for photographic purposes are not included unless otherwise stated. Packaging presentation may vary to that shown in the photo.
12.4. Delivery options may vary for Christmas hampers. Please see Website for more details.
12.5. Hampers, food and perishable goods are non-returnable, except in relation to faulty or incorrectly supplied goods where your statutory rights are unaffected.
12.6. Neither Global-e nor Harrods will be responsible for any damage caused by your storage of the hamper.
12.7. Please follow the care guidelines enclosed within your hamper to best preserve products included.
13.1. Gift Cards can be used as a payment method for purchases made in-store and online (for orders placed for delivery in the UK only).
13.2. Up to five Gift Cards can be redeemed per transaction for purchases made online.
13.3. The balance of a Gift Card may be used until either it is fully depleted or the Gift Card has expired. The Gift Card will expire and be deactivated after 24 months of non-use.
13.4. Neither Global-e nor Harrods is responsible for lost, stolen, expired or damaged Gift Cards.
13.5. Neither Global-e nor Harrods is under any obligation to transfer any remaining balance on a lost, stolen, expired or damaged Gift Card.
13.6. Neither Global-e nor Harrods is liable for any unauthorised use of lost or stolen Gift Cards prior to their cancellation and any balance from a cancelled Gift Card transferred by Harrods onto a new Gift Card will have the value of those unauthorised purchases deducted accordingly.
13.7. Gift Cards are non-refundable, non-transferable and cannot be exchanged for cash. Refunds for returns on purchases made using a Gift Card will be issued back onto the original Gift Card.
13.8. Gift messaging will be available where indicated during the checkout process.
13.9. You are responsible for the content of gift messages. Neither Global-e nor Harrods can make changes to gift messages after you have completed the checkout process.
13.10. Global-e and Harrods reserve the right to refuse messages (including not limited to where Harrods determines that messages include obscene, offensive or other inappropriate language) or to discontinue or temporarily suspend access to the gift message service at any time, entirely at Harrods’ own discretion and without liability to you.
13.11. This section 13 applies in addition to any other Gift Card terms and conditions made available to you, including those terms and conditions printed on physical Gift Cards.
14.1. Harrods (and not Global-e) may offer certain Harrods Experience vouchers. Such vouchers are offered separately under their own terms and conditions and excluding this Clause 13, are not subject to these Terms of Sales. The vouchers:
14.1.1. feature a unique reference ID code and may be redeemed only once;
14.1.2. cannot be redeemed within 72 hours of purchase; and
14.1.3. may not be exchanged for cash, are non-transferable and are not replaceable by Harrods if lost.
14.2. All Harrods Experiences are subject to availability and should be booked in advance.

15.1. If any Product you order is damaged or faulty when delivered to you, or has developed a fault, you may have one or more legal remedies available to you, depending on when you make Harrods aware of the problem, in accordance with your legal rights under applicable laws. If you believe a Product is faulty, you should inform Harrods Customer Service as soon as possible, stating your name, address and order reference. Nothing in this section affects your legal rights under applicable law.
15.2. For Products shipped internationally, please note that any applicable warranty may not be valid in the shipping destination, or you may have only limited warranty valid in the shipping destination. If a warranty is valid and not limited by your jurisdiction, then the warranty period is as set out in the product description. Consumers in some jurisdictions may have legal rights under applicable local legislation governing the sale of consumer goods, including, without limitation, national laws implementing EU directive 2019/771.
15.3. For clarity, any defects or damage caused by accident or by your use of the Products not in accordance with their intended use or by normal wear and tear will not be deemed faulty and may not be eligible for a refund or replacement.
16.1. There are certain liabilities that cannot be excluded under applicable law. In particular, nothing in these Terms limits Global-e’s or Harrods’ liability for personal injury or death caused by Global-e’s or Harrods’ negligence or the negligence of its respective employees, agents or subcontractors, or liability for Global-e’s or Harrods’ fraud. You might have certain non-excludable rights under the consumer legislation applying in the country in which your Order was delivered which explicitly prevails over the governing law of these Terms, including legal rights relating to faulty product(s). Nothing in these Terms will affect these explicitly prevailing non-excludable legal rights.
16.2. SUBJECT TO CLAUSE 16.1, IN NO EVENT WILL GLOBAL-E OR HARRODS HAVE ANY LIABILITY FOR ANY OF YOUR LOSSES, ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, HOWSOEVER CAUSED INCLUDING ARISING DIRECTLY OR INDIRECTLY FROM OR IN CONNECTION WITH THESE TERMS. ANY LIABILITY, IF SO EXISTS, SHALL NOT EXCEED THE PURCHASE PRICE OF THE RELEVANT PRODUCT AND IS STRICTLY LIMITED TO LOSSES THAT WERE REASONABLY FORESEEABLE. LOSSES ARE FORESEEABLE WHERE THEY COULD BE CONTEMPLATED BY YOU AND GLOBAL-E OR HARRODS (AS APPLICABLE) AT THE TIME YOUR ORDER IS ACCEPTED. THE LIABILITY OF GLOBAL-E OR HARRODS TO YOU FOR LOSS OR DAMAGE OF ANY KIND ARISING OUT OF THESE TERMS WILL BE REDUCED OR LIMITED TO THE EXTENT (IF ANY) THAT YOU CAUSE OR CONTRIBUTE TO THE LOSS OR DAMAGE.
16.3. GLOBAL-E AND HARRODS WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGES INCURRED BY UNAUTHORIZED USE OF YOUR PAYMENT CARD ON THE CHECKOUT, AND NEITHER GLOBAL-E NOR HARRODS ARE RESPONSIBLE FOR NOTIFYING YOUR CARD ISSUER OR ANY LAW ENFORCEMENT AUTHORITY IN THESE INSTANCES.
16.4. Subject to clause 16.1, neither Global-e nor Harrods will be held liable for any allergic reactions in relation to the use or consumption of Products. For specific information about ingredients and allergies in any of our food Products, please refer to the specific product page or contact our Customer Service team.
16.5. You must give Global-e and/or Harrods (as applicable) a reasonable opportunity to remedy any matter for which they are liable before you incur any costs remedying the matter yourself.
The Website and all intellectual property rights in it, including but not limited to any content, are owned or licensed by Harrods Limited. Nothing in these Terms grants you any legal rights in the Website other than as necessary to enable you to access the Website. Any access or use of the checkout for any reason other than your personal, non-commercial use, is prohibited. You further acknowledge that any other use of the material and content of the checkout or the Website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
18.1. These Terms are governed by the laws of England and Wales.
18.2. When a specific applicable law (namely specific consumer laws in your country), explicitly prevails the laws of England and Wales then, with respect to the prevailing subject matter, the governing law of such matter will be that specific law.
18.3. To the fullest extent permitted by applicable law, any dispute arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the English courts.
18.4. Alternative dispute resolution (“ADR”) is a process where an independent body considers the facts of a dispute and produces a written determination which is binding on Harrods, meaning that you do not need to go to court in relation to the handling of a dispute with Harrods. The ADR scheme is free for consumers to use. If you are not happy with how Harrods has handled any complaint, you may want to contact the Government approved ADR provider used by Harrods, RetailADR. You can submit a complaint to RetailADR by visiting https://support.cdrl.org.uk and completing the online support form. You may also submit your complaint in writing (at RetailADR, 12–14 Walker Avenue, Wolverton Mill, Milton Keynes MK12 5TW), by email ([email protected]) or by phone (+44 (0)20 3540 8063).
19.1. All communications will be made in the English language and electronically by sending email or otherwise posting electronically.
19.2. Global-e is committed to carrying on its business in accordance with its Code of Conduct and Modern Slavery Policy (available here).
19.3. Any failure by either party to exercise or enforce any right or provision of these Terms does not mean this is a “waiver” (i.e. that it cannot be enforced later).
19.4. Headings used in these Terms are for information and are not binding.
19.5. These Terms, or any part thereof, may be assigned by Global-e or Harrods to a third party, without your consent, but this will not affect your rights or obligations. A person who is not a party to these Terms shall have no rights to enforce any term of these Terms except insofar as expressly stated otherwise.
19.6. Global-e and Harrods reserve the right to process and (where required) disclose any information obtained in connection with the Order, and your use of the checkout, as is deemed necessary to: (i) satisfy any applicable law, regulation, legal process, subpoena or governmental request; (ii) enforce these Terms, including to investigate potential violations of them; (iii) detect, prevent, or otherwise address fraud, security or technical issues; (iv) support Harrods in responding to your requests; or (v) protect and fulfil Global-e’s and Harrods’ legitimate interests.
19.7. The Website and/or checkout may contain links to third party websites or services that are not owned or controlled by Global-e. Global-e is not affiliated with, has no control over, and assumes no responsibility for the content, privacy policies, or practices of, any third-party websites. You: (i) are solely responsible and liable for your use of and linking to third party websites and any content that you may send or post to a third-party website; and (ii) expressly release Global-e and Harrods from any and all liability arising from your use of any third-party website. Accordingly, you are encouraged to read the terms and conditions and privacy policy of each third-party website that you may choose to visit.
19.8. Global-e and/or Harrods reserves the right to modify these Terms at any time by posting the changes on the checkout or the Website. Such change will take effect on the posting date of the revised Terms, and your use of the checkout after such changes have been posted means that you agree to be bound by the Terms as modified. However, no such change will affect any Order that you have already placed.
19.9. These Terms constitute the entire agreement with respect to the subject matter of the Order. The contract in respect of any Orders is concluded between you and Global-e or its intra-group affiliate acting on Global-e’s behalf.
19.10. If any provision of these Terms is determined by a court of competent jurisdiction to be invalid or unenforceable, it shall be deemed severable and the remaining provisions of the Terms shall remain in full force and effect. If any provision is deemed unenforceable due to being too broad or for any other reason, you agree to substitute a lawful provision that gives effect to the original intent of the parties as closely as possible.

20.1. European Economic Area (EEA)
20.1.1. Consumer Withdrawal Rights –If you are a “Consumer” and a resident of a member state of the European Union, Iceland, Liechtenstein, or Norway ("EEA"), you have a “cooling-off” right to cancel your Order subject to the provisions set out below. This right is not affected by any separate returns policy in these Terms.
20.1.2. Instructions for Withdrawal:
(a) The withdrawal cancellation period will expire 14 days after the day of delivery.
(b) To exercise the right to withdraw you must follow the same instructions as detailed in the refund policy above and the same terms of the returns policy will apply, subject to and with the following changes:
(i) Informing about your decision to withdraw from the Order must be done within 14 days as of the day of delivery of the Product to you or to somebody named by you (and not 30 days as of date Order was placed).
(ii) You should inform Harrods of your intent to withdraw through the methods stated in the refund instructions above (i.e. through the returns portal which is available on the Website or in the Online Support link which is in Order Confirmation, or if such are not available by contacting Harrods customer support). However, you may also inform Harrods by using the model withdrawal/cancellation form available here, although it is not obligatory to use this form.
(iii) You must return the product in the condition mentioned in the return policy above, except you may use the product only for such use that is necessary to assess the nature, characteristics and functioning of the Product, as you would have used in a physical store. Deduction could be made from the reimbursement for loss in value of any item supplied, if the loss is the result of your handling beyond what is necessary to establish the nature, characteristics and functioning of the item.
(iv) Initial Delivery Costs you paid in connection with the Order will be reimbursable or refundable (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us).
(c) Refund will be made not later than 14 days from the time Harrods received your cancellation request, however if a supplied Product has not been received back from you during such time period, Refund may be delayed until such time the Products is received back, or if earlier, until the time you provide sufficient evidence that you have returned the Product.
20.1.3. For consumers in the EU:
(a) If you are a consumer you may use the European Commission platform for online dispute resolution (ODR) (For information about alternative dispute resolution which may be of interest, please refer to http://ec.europa.eu/consumers/odr/) or such other institution to which you may have a legal right to use under applicable law.
(b) you may have legal rights in relation to Products that are not as described, not of satisfactory quality, or otherwise not fit for purpose
20.1.4. For consumers in Denmark:
(a) You may file a complaint with "Nævnenes Hus, Mæglingsteamet for Forbrugerklager, Toldboden 2, 8800 Viborg" via Klageportalen - Nævnenes Hus (naevneneshus.dk).
(b) Danish consumers can use the EU Commission's online complaint form at Onlinetvistbilæggelse | Europa-Kommissionen.
(c) the limitation of liability under these Terms will not apply in the event of claims arising out of gross negligence or wilful misconduct
20.1.5. For customers in France:
(a) If the Global-e Contracting Party is an entity incorporated in the EU or if you are otherwise entitled, you may have a right to invoke the legal warranty of conformity (article L217-4 and seq. of the French consumer Code) within a period of two (2) years from the delivery of the Products, without having to prove that the defect existed before the delivery. You may be able to benefit from the following options depending on what is possible and subject to the cost conditions provided for in Article L217-9 of the Consumer Code: (i) the replacement of the Products by an identical product or of equivalent quality and price, depending on available stocks; or (ii) the repair of the Products.
(b) If these two solutions are impossible to implement within thirty (30) days following your request according to the conditions provided for in Articles L217-9 and L217-10 of the French Consumer Code a full refund (purchase price and possible delivery costs) will be issued, against return of the Products. The cost of returning the Products, the cost of repairing it or of delivering another Products will be borne by us.
(c) You may also have the right to invoke the legal warranty against the hidden defects provided in articles 1641 to 1649 of the French Civil Code or any other contractual or extra-contractual action (tort) which is recognized by the law. In such a case, the consumer can choose between the termination of the sale or claim a reduction of the price pursuant to Article 1644 of the Civil Code. Pursuant to article 1648 paragraph 1 of the Civil Code, the action resulting from latent defects must be filed within two (2) years of the discovery of the defect.
20.1.6. For consumers in Germany:
(a) The statutory warranty rights apply with respect to Products that is not free of legal and/or material defects.
20.1.7. For consumers in Italy:
(a) If the Global-e Contracting Party is an entity incorporated in the EU or if you are otherwise entitled, you may have a right to invoke the legal warranty of conformity (the "Legal Guarantee") provided for in Articles 128 et seq. of Italian Legislative Decree No. 206 of December 6, 2005 (the "Consumer Code").
(b) In particular, you may be entitled to make a claim under the warranty of conformity for any lack of conformity existing at the time of delivery of the Product, provided that the lack of conformity has become apparent within the term of 2 (two) years from delivery of the Product and was reported by you to customer support within such time frame. A claim hereunder must contain an accurate and complete description of the defects or faults complained of and photos of the product, highlighting the reported lack of conformity.
(c) If the reported defect exists, you will not be charged for the delivery costs of returning the defected Product.
(d) When returning the Product you must include the defect report form (duly completed) and attach the shipment labels and RMA number provided to you via e-mail to the returned package and any other document reasonably requested by Global-e or Harrods.
(e) You may be able to benefit from the following options depending on what is possible and subject to conditions provided under applicable law: (i) repair of the faulty Product (ii) replacement of the faulty Product (iii) a reasonable reduction in price or (iv) termination of the sale contract. where it was verified that the reported lack of conformity does not exist or that there are no prerequisites for the applicability of the Legal Guarantee, the Legal Guarantee will not operate and all transportation costs - both those incurred by you to send the Product to Harrods and vice versa - will be borne by you.
(f) If the Global-e Contracting Party is an entity incorporated in the EU, the limitation of liability under these Terms will not apply in the event of claims arising out of gross negligence or willful misconduct.
20.1.8 For consumers in Sweden
(a) you may use the alternative dispute resolution process provided by the ARN (www.arn.se).
20.2. Australia
20.2.1. All terms, conditions, warranties and representations that might otherwise be granted or implied by Australian law, are hereby expressly excluded, except for any liability that cannot be excluded, restricted or modified, or which cannot be excluded, restricted or modified except to a limited extent, as between the parties by law including liability under the Competition and Consumer Act 2010 (Cth). Nothing restricts you rights under the Australian Consumer Law, these rights include:
(a) If your Products fails to meet a consumer guarantee under the Australian Consumer Law, you will be entitled to a repair, replacement or refund depending on whether the defect is classified as a minor or major defect. A consumer guarantee under the Australian Consumer Law includes a guarantee that the product is of acceptable quality, matches the description provided in the Site, is fit for purpose and meets any extra promises made about performance, condition and quality.
(b) If the defect is considered a minor failure of the Product, your Product may be repaired, replaced or you will be refunded for your purchase, as elected by Global-e or Harrods.
(c) If the defect is considered a major failure of the Products, you are entitled to reject the goods and choose a refund or replacement of the Product, or ask for compensation for any drop in value of the goods.
20.2.2. Section 4 (Duties and Taxes), including in relation to return costs and claiming back Import Charges in cases of returns or other eligible circumstances, is subject to your rights under the Australian Consumer Law (including in relation to return costs under the consumer guarantees).
20.2.3. The final two paragraphs of section 5 (Title; Risk; Importer of Record) are subject to your rights under the Australian Consumer Law, including under the consumer guarantees.

(a) You hereby consent to the following Power of Attorney, which is extended to Globale UK Limited: Globale UK Limited. is an approved CREDITS participant with the Canada Border Services Agency (CBSA). By ordering goods from Globale UK Limited., I hereby authorize DHL Express (Canada), Ltd. an approved customs broker in CREDITS, to act as my agent, and to transact business with the CBSA to obtain release of my Product, account for duties and taxes, return Product to Globale UK Limited., and electronically submit refund claims on my behalf. Under the CREDITS program, I understand that the CBSA will send any refund of duties and taxes that were paid on the returned Product to the customs broker, and that I will obtain the refund directly from Globale UK Limited.
